Dear Sirs and Ma'ams:
After careful consideration and review of the proposed amendment number 44 to the United States Sentencing Guidelines, it is clear that the changes should be made -- and they should be retroactive!
A person who is indicted for fraud and convicted, where the loss is $12,000.00, would normally receive a moderate sentence. If that person wrote a check with the money, they could be charged with a violation of 18 USC 1957 and their sentence raised to a harsh sentence of more than three years. This has happened on several occasions.
In order for the Commission to complete its goal of fair sentences without disparity, the Commission must cause this amendment to go into effect retroactively.
